Purpose

The FIFTHQTR Foundation is trusted with information of a private and personal nature. This information is obtained in an operational capacity as FIFTH QTR Foundation assists AFL, AFLW past players and community athletes maintain positive mental health wellbeing
and successfully transition from sport.

This policy identifies the FIFTHQTR Foundations commitment to protecting and maintaining privacy and applies to all FIFTH QTR Foundation Board members, members, staff, volunteers and controlled entities.

Scope

The FIFTHQTR Foundation is committed to protecting the privacy of individuals and this policy identifies how the FIFTHQTR Foundation will protect information obtained during dealings with the organisation.

Furthermore, it outlines the FIFTHQTR Foundations ongoing obligations to individuals in respect of how we manage personal Information.

The FIFTHQTR Foundation has adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (the Privacy Act). The APPs govern the way in which the FIFTHQTR Foundation collects, uses, discloses, stores, secures and disposes of personal Information.

The FIFTHQTR Foundation values and respects the privacy of the people they deal with and is committed to protecting their privacy and complying with the Privacy Act 1988 (Cth) and other applicable privacy laws and regulations.

This Privacy Policy (Policy) describes how the FINTHQTR Foundation collects, holds, uses and discloses personal information and how they maintain the quality and security of personal information.

Personal information” means any information or opinion, whether true or not, and whether recorded in a material form or not, about an identified individual or an individual who is reasonably identifiable. In general terms, this includes information or an opinion that personally identifies a person either directly (e.g. your name) or indirectly.

What is Sensitive Information?

Sensitive information is a subset of personal information, and may include, for example, a person’s religious or philosophical beliefs, sexual orientation or health information.

What Personal Information is collected?

The personal information the FIFTHQTR Foundation collects on individuals depends on the nature of individual dealings and what individuals chose to share. The personal information collected about individuals may include:

  • mailing or street address;
  • date of birth;
  • email address;
  • phone number;
    • personal needs;
    • personal history;
  • personal challenges;
    • services referred to and accessed.

Under certain circumstances, the FIFTHQTR Foundation may need to collect sensitive information about individuals. This might include any information or opinion about their racial or ethnic origin, political opinions, political association, religious or philosophical beliefs, membership of a trade union or other professional body, sexual preferences, criminal record, or health information.

If the FIFTHQTR Foundation collects sensitive information, they will do so only with an individual’s consent.

If it is necessary to collect sensitive information to prevent a serious and imminent threat to life or health, or as otherwise required or authorised by law, then the FIFTHQTR Foundation will take appropriate measures to protect the security of this information.

Individuals do not have to provide the FIFTHQTR Foundation with any personal information.

Where possible, the FIFTHQTR Foundation will give individuals the option to interact with them anonymously or by using a pseudonym. However, if individuals choose to deal with the FIFTHQTR Foundation in this way ,or chooses not to provide the FIFTHQTR Foundation with personal information, they may not be able to provide individuals with services or interact.

How does FIFTHQTR Foundation collect Personal Information?

The FIFTHQTR Foundation will collect personal information directly from individuals when interacting:

  • over the phone;
  • in person;
  • online;
  • in surveys or questionnaires;
  • at an event;
  • subscribing to mailing lists;
  • applying for a position as an employee, contractor or volunteer;
    • with service providers
    • case managers

The FIFTHQTR Foundation may also collect personal information from third parties or through publicly available sources. For example, from:

  • sporting bodies;
  • employers;
  • suppliers;

The FIFTHQTR Foundation can collect personal information from these third parties so that they can assist individuals maintain their mental health and wellbeing or help individuals access additional services.

How do we use an Individuals Personal Information

The FIFTHQTR Foundation uses personal information for many purposes in connection with their functions and activities, including the following purposes:

  • providing individuals with information or services that requested from FIFTHQTR Foundation;
  • deliver to individuals a more personalised experience and service offering;
  • improving the quality of the services offered;
  • internal administrative purposes;
  • marketing and research purposes;
    • Website promotion, including case studies and athlete stories

Disclosure of Personal Information to Third Parties

The FIFTHQTR Foundation may disclose an individual’s personal information to third parties in accordance with this Policy in circumstances where you would reasonably expect the FIFTHQTR Foundation to disclose information. For example, the FIFTHQTR Foundation may disclose an individual’s personal information to:

  • third party service providers. For example, service providers, suppliers,
    information technology providers;
  • our marketing providers;
  • our professional services advisors;

Transfer of Personal Information Overseas

Some of the third-party service providers the FIFTHQTR Foundation discloses personal information to may be based in or have servers located outside of Australia. Where the FIFTHQTR Foundation discloses an individual’s personal information to third parties overseas, they will take reasonable steps to ensure that data security and appropriate privacy practices are maintained.

The FIFTHQTR Foundation will only disclose to overseas third parties if:

  • an individual has given FIFTHQTR Foundation consent to disclose personal information to that third party; or
  • the FIFTHQTR Foundation reasonably believes that:

    • the law or binding scheme can be enforced; or

How does the FIFTHQTR Foundation protect Personal Information?

The FIFTHQTR Foundation will take reasonable steps to ensure that the personal information held about individual’s is kept confidential and secure, including by:

  • installing and maintaining robust physical security of premises and databases / records;
  • taking measures to restrict access to only personnel who need that personal information to effectively provide services to individuals;
  • having technological measures in place to prevent unauthorised access to records.

For example, anti-virus software, fire walls, cyber protections.

Online Activity

The FIFTHQTR Foundation website uses cookies. A cookie is a small file of letters and numbers the website puts on your device if you allow it. These cookies recognise when your device has visited the FIFTHQTR Foundation website(s) so we can distinguish you from other users of the website. This improves your experience using the FIFTHQTR website(s).

We do not use cookies to identify you, just to improve your experience on the FIFTHQTR website(s). An individual’s consent to FIFTHQTR sending them direct marketing communications by any of those methods is required. If an individual indicates a preference for a method of communication, FIFTHQTR will endeavour to use that method whenever practical to do so. An individual may opt-out of receiving marketing communications from FIFTHQTR at any time by following the instructions to “unsubscribe” identified in the relevant communication or by contacting the FIFTHQTR using the details set out in the “How to contact us” section on the website.

FIFTHQTR may also use an individual’s personal information or disclose personal information to third parties for the purposes of advertising, including online behavioural advertising, website personalisation. But an individual’s consent is required before the FIFTHQTR will do so.

Retention of Personal Information

The FIFTHQTR Foundation will not keep personal information for longer than needed. In most cases, this means that the FIFTHQTR Foundation will only retain personal information for the duration of an individual’s relationship unless the FIFTHQTR Foundation is required to retain an individual’s personal information to comply with applicable laws, for example record-keeping obligations.

How can an individual access and correct personal information?

The FIFTHQTR Foundation will endeavour to keep personal information accurate, complete and up to date. If an individual wishes to make a request to access and / or correct the personal information held about them, they should make a request by contacting FIFTHQTR Foundation who will respond within five days.

THE FIFTHQTR FOUNDATION website(s) may contain links to websites operated by third parties. If an individual access a third party website through the FIFTHQTR Foundation website(s), personal information may be collected by that third party website.

The FIFTHQTR Foundation makes no representations or warranties in relation to the privacy practices of any third party provider or website and they are not responsible for the privacy policies or the content of any third party provider or website. Third party providers / websites are responsible for informing an individual about their own privacy practices and the FIFTHQTR Foundation encourages individuals to read their privacy policies.

Inquiries and Complaints

For complaints about how the FIFTHQTR Foundation handles, processes or manages personal information, please contact the Operations Director. The FIFTHQTR Foundation will require proof of an individual’s identity and receive full details of their request before they will process the complaint.

Please allow up to 14 days for the FIFTHQTR Foundation to respond to a complaint. It will not always be possible to resolve a complaint to everyone’s satisfaction.

If an individual is not satisfied with the FIFTHQTR Foundation’s response to a complaint, they have the right to contact the Office of Australian Information Commissioner (at www.oaic.gov.au/) to lodge a complaint.
